ExamCrafter provides an AI-powered platform for generating educational assessments and exams from uploaded documents. The service includes document processing, question generation, exam editing, and PDF export capabilities.

3. User Accounts

To access certain features of the service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use ExamCrafter only for lawful purposes and in accordance with these Terms. You agree not to use the service:

In any way that violates any applicable federal, state, local, or international law or regulation
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service

5. Content Guidelines

You retain ownership of the content you upload to ExamCrafter. However, by uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing our services to you.

You represent and warrant that you have all necessary rights and permissions to upload and use the content you provide to ExamCrafter.

6. AI-Generated Content

The exam questions and assessments generated by our AI technology are provided as suggestions and should be reviewed and verified for accuracy, appropriateness, and educational value before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

7. Intellectual Property

The ExamCrafter service, including its original content, features, and functionality, is and will remain the exclusive property of Iterative Works GmbH and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Privacy Policy

Your use of ExamCrafter is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Payment Terms

If you purchase a subscription or credits to use ExamCrafter, you agree to pay all fees according to the pricing and payment terms presented to you at the time of purchase. Fees are non-refundable except as required by law or as explicitly stated in these terms.

10. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

12. Limitation of Liability

IN NO EVENT SHALL ITERATIVE WORKS GMBH, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to defend, indemnify, and hold harmless Iterative Works GmbH and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
